SHOUTOUT APP TERMS & CONDITIONS

1. Registration and participation in the ShoutOut App constitutes acceptance of these Conditions of Entry and the General Terms and Conditions of your organisation.

a) Company employees are expected to use the ShoutOut App responsibly and productively.

b) All data that is composed, transmitted and/or received by the ShoutOut Group computer systems and the ShoutOut App software is considered to belong to ShoutOut Group and is recognised as part of its official data. It is therefore subject to disclosure for legal reasons or to other appropriate third parties.

c) Messages and Posts using the ShoutOut Wall and the Connect Module sent via the ShoutOut App should not contain content that is deemed to be offensive. This includes, but is not restricted to;

  1. contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable;
  2. contain or promote sexual or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  3. infringe any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person;
  4. violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with this agreement;
  5. be likely to deceive any person;
  6. promote any illegal activity, or advocate, promote or assist any unlawful act;
  7. cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;
  8. impersonate any person, or misrepresent your identity or affiliation with any person or organisation, including with us; and/or
  9. give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

d) Posts on the ShoutOut App may be monitored, edited, removed and/or blocked by ShoutOut Group and official Company administrators if they are deemed to be harmful and/or not productive to business.

e) Use of the ShoutOut App is permitted and encouraged where such use supports the goals and objectives of the business. However, access to the App is a privilege and all users must adhere to the policies concerning Computer, Email and Internet usage. Violation of these policies could result in disciplinary and/or legal action leading up to and including termination of employment at the discretion of the official Company administrators.

f) Users acknowledge and agree we may:

  1. collect aggregated information about your activities, and details of how you use the Platform, the types of content you engage with or the frequency and duration of your activities;
  2. collect metadata, which is technical data that can describe the details of how User Contributions was collected and how that content is formatted; and
  3. automatically store in log files, including IP addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data to analyse trends, to administer the Platform, to generally improve the Platform.

g) Users may also be held personally liable for damages caused by any violations of this policy. All users are required to acknowledge receipt and confirm that they have understood and agree to abide by the rules hereunder when they register on the ShoutOut App.

a) The administrator for the ShoutOut App is ShoutOut Group App PTY LTD. Please contact [email protected] for any technical issues regarding the ShoutOut App or your company administrator for issues regarding registration of access.

 

SHOUTOUT APP PRIVACY POLICY

ShoutOut Group App provides a service that gets peers connected, engaged, and shows everyone on the team that they matter.

In the course of carrying out our activities ShoutOut Group App Pty Ltd and the ShoutOut Group App (we, us or our) will collect, store, use and disclose personal information collected from users of the www.shoutoutgroup.com.au website or application (Platform) or through other interactions with us.

We are committed to the protection of your personal information and to compliance with Australian privacy law.
We encourage you to review our Privacy Policy whenever you access the Platform or otherwise interact with us to stay informed about our information practices and the choices available to you.

Personal information

Personal information is information or an opinion about an identified or reasonably identifiable individual, whether or not the information or opinion is true and whether or not the information is recorded in a material form.

Types of personal information we collect and hold

We collect and hold personal information about individuals for the provision of our services and purposes connected to those services.

Consistent with the provision of our services, the types of personal information we may collect and hold includes:

  1. individuals’ name, likeness (in the form of a profile photo), mobile telephone number, birthday, employment commencement date and email address;
  2. text of written and oral communications gathered in the course of our interaction with you, including where you send or receive ShoutOuts, comment within our Platform and/or otherwise interact on live-chat, social media and emails, including feedback and online reviews and other information from your interactions with us online, including cookie information, IP address, URLs, search histories and other associated information;
  3. KPI data regarding your participation in a performance module; and
  4. information regarding your access to and redemption of e giftcards.

You may, however, visit our Platform anonymously but certain functionality may not be available to you.

How we collect and hold personal information

We may collect personal identification information from you in a variety of ways, including, but not limited to, when you visit our Platform, register on the Platform, subscribe to the newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Platform. We will collect personal identification information from you only if you voluntarily submit such information to us. You may refuse to supply personal information, except that it may prevent you from engaging in certain Platform related activities.

Personal information is held securely, is subject to various security protections and is held only for as long as the information remains relevant to the purpose for which it was collected. We archive any historical data and have a Back Up Policy that requires we consistently back up our servers.

We may collect non-personal identification information about you whenever you interact with our Platform. Non-personal identification information may include your mobile device type (e.g. Apple of Android),the browser name, the type of computer and technical information about your means of connection to our Platform, such as the operating system and the Internet service providers utilized and other similar information.

Browser cookies

Our Platform may use “cookies” to enhance your experience. Your web browser places cookies on your hard drive for record-keeping purposes and sometimes to track information. You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. If you elect to refuse cookies, some parts of the Platform may not function properly.

Purposes for which we hold, use and disclose information

We will not use or disclose personal information for any secondary purpose, unless that secondary purpose is related to the primary purpose for which we have collected that information, and you would reasonably expect the disclosure in the circumstances, or unless you consent to that use or disclosure.

The purposes for which we hold, use and disclose information include:

  1. conducting our business and improving our products, services and the Platform;
  2. to improve customer service including to respond to your customer service requests and support needs more efficiently;
  3. to personalise user experience;
  4. to understand how our users as a group use the services and resources provided on our Platform;
  5. to communicate information about our products and services or third party products or services that may be of interest to you and respond to your inquiries, questions, and/or other requests; and
  6. for our internal administrative, research, planning, marketing and product development.

Protecting your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Platform.

Sensitive and private data exchange between the Platform and its users happens over an SSL secured communication channel and is encrypted and protected with digital signatures.

Sharing your personal information

We do not sell, trade, or rent your personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Platform or administer activities on our behalf, such as sending out e gift cards, newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

Access and correction

We will take all reasonable steps to ensure any personal data we collect, use or disclose is up to date and accurate. If you believe personal information we hold about you is not up to date or accurate, you may ask us to correct it.

You may ask us to provide you with details of the personal information we hold about you, and copies of that information. We will respond to your request and attempt to provide you with the data within 30 days of receipt of your request.

If we provide you with copies of the information you have requested, we may charge you a reasonable fee to cover the administrative costs of providing you with that information.

Changes to this policy

We will review and update this Privacy Policy from time to time as needed without notice. Therefore, you should review the terms of this policy periodically to make sure that you are aware of how we collect, hold, store and use personal information.

 

Complaints

If you consider a breach of the Privacy Act 1988 (Cth) has occurred, you may direct your query to our Privacy Officer and we will attempt to resolve your complaint.
